Participation Agreement

This Participation Agreement (“Agreement”) is entered into by the enrolling parent or legal guardian (“Parent”) on behalf of the enrolled student (“Participant”) in connection with participation in any Rhetrix LLC program, including Summer Day Camps, Fall and Spring Cohorts, and any other Rhetrix-delivered coaching sessions.

Description of Program Activities

Rhetrix programs are live, in-person youth communication and confidence coaching programs for students in grades 6 through 12. Program activities include public speaking exercises, group presentations, individual performance reps, peer feedback sessions, physical movement and posture exercises, breathing and vocal exercises, improv-based communication drills, emotional vulnerability exercises designed to build authentic confidence, and a final showcase event attended by parents and invited guests.

Acknowledgment of Inherent Risks

Parent acknowledges that participation in Rhetrix programs involves inherent risks, including but not limited to: anxiety and emotional discomfort associated with public speaking and performance; physical activity including movement, posture drills, and breathing exercises; the emotional vulnerability involved in peer feedback and personal storytelling exercises; and the possibility of minor physical injury incidental to group activities. Parent acknowledges that these risks cannot be eliminated without defeating the purpose of the program, and that they are a necessary and intended part of the Rhetrix experience.

Assumption of Risk

Parent voluntarily assumes all inherent risks described above on behalf of the Participant and acknowledges that Rhetrix LLC has made no guarantees regarding program outcomes. Parent further acknowledges that all Rhetrix sessions are recorded for a private recap video delivered exclusively to the enrolled family. These recordings are not shared publicly. By enrolling, Parent consents to this private session recording.

Release of Liability and Hold Harmless

To the fullest extent permitted by Georgia law, Parent releases, waives, and holds harmless Rhetrix LLC, its owner, agents, volunteers, and venue partners from any and all claims, demands, causes of action, and liability arising out of or related to the Participant's participation in any Rhetrix program, including claims arising from the ordinary negligence of Rhetrix LLC.

THIS RELEASE DOES NOT APPLY TO AND DOES NOT LIMIT LIABILITY FOR: gross negligence; willful or wanton misconduct; intentional acts; sexual abuse, sexual misconduct, or physical abuse of any kind; criminal conduct; violations of mandatory child abuse reporting obligations under O.C.G.A. § 19-7-5; or any other liability that cannot be waived as a matter of Georgia law.

IMPORTANT NOTICE REGARDING MINORS: Under Georgia law, a parent or guardian may not waive a minor child's own personal injury claims before an injury occurs. Accordingly, the release of ordinary negligence claims above applies to Parent's own claims and is entered into by Parent on their own behalf. To the extent a court determines this release is unenforceable as to the Participant's claims, the remaining provisions of this Agreement — including the limitation of liability, dispute resolution, and arbitration clauses — remain in full force and effect.

Parent acknowledges that this Agreement is entered into voluntarily and with full understanding of its terms.

Medical Authorization

In the event of a medical emergency during any Rhetrix program session, and if Parent cannot be reached by phone within a reasonable time, Parent hereby authorizes Rhetrix LLC to consent to emergency medical treatment for the Participant as deemed necessary by qualified medical personnel. Rhetrix LLC will make every reasonable effort to contact a parent or guardian before consenting to non-emergency treatment.

Emotional Safety and Wellbeing Protocol

Rhetrix programs include exercises designed to build emotional presence, including personal storytelling, peer feedback, and vulnerability-based activities. These exercises are powerful by design and may surface strong emotional responses, including anxiety, distress, or the disclosure of difficult personal experiences. If a student becomes significantly distressed during a session — including a panic response, uncontrollable crying, or a disclosure that raises a concern about the student's safety or wellbeing — Rhetrix will: (1) pause the activity and give the student space away from the group in an open, supervised area; (2) attempt to contact a parent or guardian by phone before continuing; and (3) evaluate whether it is appropriate for the student to return to the session that day. Rhetrix will not continue to push a student through a distress response. Rhetrix will communicate the incident to a parent or guardian before pick-up whenever possible, and no later than the same day. If a student's disclosure raises a reasonable suspicion of child abuse or neglect, Rhetrix will make a mandatory report consistent with O.C.G.A. § 19-7-5, as described in the Mandatory Reporting section above. Rhetrix does not provide mental health counseling or crisis intervention. If a student's needs appear to exceed what Rhetrix can safely support in a group program setting, Rhetrix may, in its sole discretion, pause or discontinue a student's participation and recommend that the family seek appropriate professional support before re-enrolling.

Emergency Contact and Medical Information

Parent agrees to provide accurate emergency contact and medical information at the time of enrollment, including: primary parent/guardian name, cell phone, and email; emergency contact name, relationship, and phone number; and any allergies, current medications, or medical or psychological conditions relevant to program participation. Parent is also encouraged to provide the Participant's physician name and phone number and health insurance carrier and policy number, if known — this information is used solely to facilitate emergency care and is never shared with advertisers. Parent agrees to notify Rhetrix LLC of any changes to this information before the affected session.

Drop-Off and Pick-Up

Parent agrees to adhere to the published drop-off and pick-up policy. Students may be dropped off no more than 10 minutes before session start. Pick-up must occur within 15 minutes of session end. No student will be released to an adult not listed on the Emergency Contact Form without written authorization from the enrolling parent or guardian received before that session ends. If a student is not picked up within 30 minutes of session end and a parent or guardian cannot be reached, Rhetrix may contact the listed emergency contact or, if the student's safety requires it, local law enforcement.

Conduct

Parent agrees that the Participant will participate respectfully, engage honestly with program activities, and abide by the student conduct standards described in the Rhetrix Terms of Use. Parent acknowledges that removal from the program for conduct violations does not entitle the family to a refund of any amount, including the non-refundable deposit.

Mandatory Reporting

Rhetrix LLC unconditionally commits to reporting all reasonable suspicions of child abuse or neglect to the Georgia Division of Family and Children Services (DFCS) or law enforcement, consistent with the standards of O.C.G.A. § 19-7-5. This commitment cannot be waived by any agreement, including this one. Such a report may be made without prior notice to or consent from the child's parent or guardian.

Dispute Resolution

Any dispute arising under this Agreement is subject to the binding arbitration, class action waiver, and jury trial waiver set forth in the Rhetrix Terms of Use, which are incorporated here by reference. This Agreement is governed by the laws of the State of Georgia. The arbitration agreement applies to Parent's claims brought on their own behalf and, where permitted by law, on behalf of the Participant. Under Georgia law, a parent or guardian may not waive a minor child's own personal injury claims before an injury occurs. Accordingly, to the extent a court of competent jurisdiction determines that the Participant's claims cannot be compelled to arbitration as a matter of Georgia law, those claims are excluded from this arbitration agreement while all remaining provisions — including the limitation of liability and class action waiver as to Parent's own claims — remain in full force and effect.

Acknowledgment

By completing enrollment and submitting payment, Parent affirms that they have read and understand this Agreement in its entirety, that they are the legal parent or guardian of the Participant, that they have authority to enter into this Agreement on the Participant's behalf, and that they agree to be bound by its terms.
